1. General

Mobility Plus Systems LLC (“Mobility Plus,” “Mobility Plus Systems LLC,” “we,” “us,” or “our”) respects the privacy of everyone (“Sites’ visitor,” “user,” or “you”) that uses our franchise website at www.mobilityplusfranchise.com, as well as related device or online applications connected to that site (collectively, the “Sites”).

This Privacy and Cookie Policy (“Privacy Notice”) explains the types of personal information we may gather about or collect from you in connection with your use of the Sites, how we use and disclose that information, and your rights in relation to that information.

The Sites are used to provide information about Mobility Plus franchise opportunities. Submitting a form on the Sites is a request for information. It is not an offer to sell a franchise, an acceptance of an offer, or a reservation of any territory. Franchise offers are made only through a current Franchise Disclosure Document (“FDD”) delivered in compliance with the FTC Franchise Rule and applicable state law. See our Terms and Conditions.

The Sites are hosted in the United States and are subject to U.S. state and federal law. If you are accessing the Sites from other jurisdictions, you are transferring your personal information to us in the United States, and by using the Sites you agree to that transfer and to use of your personal information in accordance with this Privacy Notice. You also agree to abide by the applicable laws of the State of Illinois and U.S. federal law concerning your use of the Sites and your agreements with us, except where a non-waivable franchise or privacy statute of another state applies. If your use of the Sites would be unlawful in your jurisdiction, please do not use the Sites.

This Privacy Notice applies to MobilityPlusFranchise.com. The consumer website at mobilityplus.com may have a separate privacy notice covering product, service, and store-related activity.

Information you provide

This may include:

  • Name, email address, phone number, postal address, and state or intended territory
  • Military or veteran status if you request veteran pricing and related verification information, such as DD Form 214 details you choose to provide
  • Financial qualification information you choose to provide, such as liquid capital, net worth, or funding interest
  • Employment, business, or ownership background you include in an inquiry
  • Records of calls, emails, SMS messages, notes, and meeting requests related to franchise development

We also use analytics and advertising tags, including Google Tag Manager.

How we use this information

We use personal information to:

  • Respond to franchise inquiries and determine whether we may legally discuss an offering in your state
  • Schedule discovery calls, webinars, and meetings
  • Deliver or arrange delivery of an FDD and maintain required franchise-sales records
  • Evaluate candidate fit, territory interest, and next steps in the franchise process
  • Send transactional and, where permitted, marketing communications by email, phone, and SMS
  • Operate, secure, and improve the Sites, including spam and abuse detection

We will notify you if permitted before undertaking such disclosures.

Mobility Plus reserves the right to transfer all information in its possession to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale of all or a portion of Mobility Plus’s assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of transferred information will be subject to this Privacy Notice, or to a new privacy notice if you are given notice of that new privacy notice and an opportunity to affirmatively opt out of it.

Franchise sales and state restrictions

We are not registered to offer or sell franchises in certain states identified on our Terms page and state/unregistered pages. We may still collect an inquiry from a resident of those states so we can tell you that an offering is not available there, keep a record of the contact, and avoid making an unlawful offer. Collection of that inquiry is not an offer to sell a franchise in that state.

If you later become a franchisee, additional information will be collected and used under the FDD, franchise agreement, and related onboarding processes. Those documents control after a franchise relationship is formed.

Text Messaging / SMS

By providing your phone number and using our website contact forms, you agree to receive SMS messages from Mobility Plus. These messages may relate to franchise opportunities, follow-up on your inquiry, scheduling and reminders, requested information, and similar communications at the phone number provided. Message and data rates may apply. You must be 18 or older to use this SMS service. Reply STOP to opt out and HELP for assistance. Carriers are not liable for delayed or undelivered messages.

We will not sell or share your phone number or SMS-related data with third parties for their own marketing purposes. SMS opt-in and phone numbers collected for SMS are not sold.

3. Do We Use Cookies?

A “Cookie” is a string of information that assigns you a unique identification that a website stores on a user’s computer, and that the user’s browser provides to the website each time the user submits a query to the website. We use cookies and similar technologies on the Sites to keep track of services you have used, remember preferences, understand traffic, measure marketing performance, and support security.

The Sites may use:

  • Functional cookies needed for basic Site operation
  • Analytics cookies, including tools loaded through Google Tag Manager / Google Analytics

We may use third-party vendors, including Google, who use first-party cookies (such as the Google Analytics cookie) and third-party cookies together to measure Site use and, where enabled, inform, optimize, and serve ads based on your activity on the Sites. Maps and market pages

State and territory pages may display maps and demographic or market information. Map tiles and related services may be provided by third parties such as OpenStreetMap contributors and mapping libraries. Market data on those pages may be assembled with the help of AI tools from public sources. That content is informational only and is not a financial performance representation unless expressly identified as coming from Item 19 of the current FDD.

Social media

The Sites may include links or plugins that redirect you to social networks such as YouTube or LinkedIn. If you click a social plugin, that network may receive your IP address, browser data, and other information. Privacy settings for those networks are not within our control.

We may share your personal information, which may include your name and contact information (including email address), with authorized service providers that perform services on our behalf. These services may include website hosting, form processing, customer relationship management, email and SMS delivery, call tracking, analytics, advertising measurement, security and spam filtering, AI-assisted research or content structuring, document delivery, and payment processing if you later pay a fee through an authorized process.

We use third-party CRM platforms and related applications to store inquiry records, manage follow-up, schedule conversations, and send email or SMS communications. Those CRM providers act as technology vendors. They process personal information on our behalf to operate the Sites and our franchise-development process. They are not the franchisor and are not permitted to use your personal information for their own unrelated marketing.

Other service providers used in connection with the Sites may include, without limitation, website hosting and infrastructure vendors, Google (including Tag Manager and Analytics), mapping and font or content-delivery providers, email and SMS vendors, and other tools we select to operate the Sites. These providers may have access to personal information needed to perform their functions but are not permitted to share or use that personal information for their own unrelated purposes.

SMS opt-in information and phone numbers collected for SMS are not shared with third parties for their own marketing purposes.

5. Security

We take the security of your personal information seriously and use reasonable electronic, personnel, and physical measures to protect it from loss, theft, alteration, or misuse. Even the best security measures cannot fully eliminate all risks. We cannot guarantee that only authorized persons will view your personal information. We are not responsible for third-party circumvention of any privacy settings or security measures.

You are responsible for maintaining the confidentiality of any account credentials and device access. If you believe someone has gained unauthorized access to information you submitted through the Sites, notify us immediately at [email protected].

6. Privacy Rights

Depending on your state of residence, you may have rights to request access to, correction of, or deletion of certain personal information, to opt out of certain sharing or targeted advertising, or to appeal a denial of a request. To exercise available rights, email [email protected] with “Privacy Request” in the subject line and enough detail for us to verify your identity and respond.

California users — CCPA / CPRA

Mobility Plus has not disclosed or sold personal information to third parties for a business or commercial purpose in the preceding twelve (12) months in a manner that we treat as a “sale” under the California Consumer Privacy Act, as amended. Mobility Plus will not sell personal information belonging to Sites’ visitors, users, and other consumers.

If you are under 18 years of age and have publicly posted personal information on the Sites, you may request removal of that information by contacting us using the information below. Include your email address and a statement that you reside in California.

California Civil Code Section 1798.83, the “Shine the Light” law, permits California residents to request, once a year and free of charge, information about personal information we disclosed to third parties for direct marketing purposes in the preceding calendar year, if any. Submit written requests to the address listed below.

Other U.S. state privacy laws

Residents of states with consumer privacy statutes may have similar rights. We will process requests as required by applicable law. Some franchise-sales records must be retained for legal and compliance purposes and may not be deleted while those obligations apply.

7. Children

The Sites are intended for adults evaluating a business investment. Franchise inquiries are limited to individuals 18 years of age or older. The Children’s Online Privacy Protection Act (“COPPA”) protects the online privacy of children under 13 years of age. We do not knowingly collect or maintain personal information from anyone under 13, unless or except as permitted by law. Any person who provides personal information through the Sites represents that he or she is 13 years of age or older, and if submitting a franchise inquiry, that he or she is 18 or older. If we learn that personal information has been collected from a child under 13, we will take appropriate steps to delete it. Parents or legal guardians should contact us using the information below.

8. Do-Not-Track Notice

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature. Because there is not yet a common understanding of how to interpret the DNT signal, the Sites currently do not respond to DNT browser signals or mechanisms.

9. AI Tools

We use certain AI applications to help research and structure market and demographic information shown on state pages and similar content. Those tools may process prompts and public-source material. We do not use AI tools as a substitute for your independent due diligence, and we assume no responsibility for any franchisee’s business results. Do not submit sensitive personal information in free-text form fields unless it is needed to evaluate your inquiry.

10. Governing Law

Disputes over privacy issues contained in this Privacy Notice will be governed by the law of the State of Illinois, except where a non-waivable statute requires otherwise. You also agree to abide by any limitation on damages contained in our Terms and Conditions, or other agreement that we have with you.

Choice of Illinois law for this Privacy Notice does not mean we are offering or selling franchises in Illinois.

11. Privacy Notice Changes

Mobility Plus may change this Privacy Notice from time to time. Any changes will be reflected on this page and the date of the new version will be stated at the top. Unless stated otherwise, our current Privacy Notice applies to all personal information that we have about you. Users should check this page regularly. We will post new versions on the Sites and may, in our discretion, notify users of changes by email or otherwise. Keep your contact information current.
